Terms of Service

p2d, a product of Sum28 · Governed by the laws of California, USA · Effective: July 3, 2026

These Terms govern your use of p2d (“the Service”), operated by Sum28. By creating an account or using the Service, you agree to them.

1. The Service

p2d helps licensed real-estate professionals turn listing photos and facts they provide into marketing descriptions. Output is generated with the assistance of AI and is intended to be reviewed and edited by you before any use.

p2d is a software tool. Sum28 is not a real-estate broker or salesperson and is not a law firm; we do not provide brokerage, legal, or compliance services, and your use of the Service creates no brokerage, agency, fiduciary, or attorney-client relationship. The Service’s automated checks — including its Fair-Housing screening — are informational assistance only, not legal advice; consult your broker or attorney for compliance questions.

If you use the p2d iOS app, your download and use of the app itself are also governed by Apple’s standard Licensed Application End User License Agreement; these Terms govern the Service. Apple is not a party to these Terms and is not responsible for the Service.

2. Your account

You’re responsible for your account and for keeping your credentials secure. The Service is intended for licensed real-estate professionals (and people working under a licensee’s supervision) for business use; it is not a consumer service. You must provide accurate information and be at least 18.

3. Credits, billing & refunds

The Service runs on credits. A listing generation’s credit cost is tiered by the number of distinct photos in the listing — duplicate and burst shots are deduplicated and never increase the price — and the exact cost is always shown in the app before you confirm. AI refinements cost the number of credits shown at the time of the action (your first AI refinement on each listing is currently free), and manual edits are free. Credits are purchased through Stripe and do not expire.

Free preview. We may offer one free preview listing per person (one per lifetime, not per account) (limited to a small number of photos, with abbreviated output). It is a one-time courtesy with no cash value; we may change or withdraw it at any time, and changes never affect credits you have purchased.

Subscriptions & automatic renewal. Starter and Pro plans renew automatically each month, and your payment method is charged the plan price shown when you subscribe until you cancel. You can cancel at any time online — the Pricing page's “Manage or cancel your subscription” portal — or by emailing info@sum28.com — email cancellations are processed promptly. Cancellation takes effect at the end of the current billing period: you will not be charged again, and you keep all credits already granted. Deleting your account also cancels any active subscription; if a payment-processor error prevents the automatic cancellation, we complete it manually and you will not be charged for periods after your deletion request. We will notify you before any price increase takes effect on a future renewal, and you may cancel before the new price applies.

Refunds. If a generation fails, the credits reserved for it are automatically returned to your balance — you are never charged credits for output you didn’t receive. Because credits do not expire, unused credits remain available for your future use. Purchases are final and credits are non-refundable, except where a refund is required by law. Prices may change prospectively; current pricing is always shown in the app, and price changes never affect credits already in your balance.

4. Your content & ownership

You own what you create. As between you and Sum28, you own the listing descriptions and other output the Service generates for you. Sum28 claims no ownership of your output and, to the extent Sum28 holds any right, title, or interest in it, Sum28 hereby assigns it to you as it arises. Because AI output may not be unique, this does not extend to similar output independently generated for other users, and it does not transfer any rights in the Service itself (our software, models, prompts, or templates).

5. MLS data

If you ask the Service to look up listing information (for example, by MLS number or address), that data is retrieved through CoreLogic Trestle under Sum28’s data-license agreement with CoreLogic. You are responsible for how you use MLS-derived facts: you represent that your own MLS membership and participation agreements permit that use, and that you use it consistently with your MLS’s rules, including rules governing its use in advertising. Sum28 grants you no rights in MLS data, does not verify it, and is not responsible for its accuracy or currency; it is provided as is, without warranty.

6. Our intellectual property

The Service — including its software, models, prompts, templates, voice corpus, and design — is owned by Sum28 and its licensors and is licensed for use, not sold. “p2d”, “Sum28”, and associated wordmarks and logos are trademarks of Sum28; these Terms grant you no right to use them.

7. Acceptable use

You will not use the Service to create — or attempt to have it create — content that is unlawful, infringing, or that indicates any preference, limitation, or discrimination based on race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by federal, state, or local law. You will not attempt to bypass or circumvent the Service’s Fair-Housing screening or other safeguards, violate MLS or advertising rules, or misrepresent a property. We may decline to generate content and may suspend accounts for attempts to do so. You are solely responsible for the accuracy of the facts you provide and the content you publish.

8. Your professional responsibility

You are the publisher of record for all advertising you create with the Service. You are solely responsible for ensuring it complies with the Fair Housing Act and state anti-discrimination laws (in California, including FEHA and the Unruh Act), your MLS’s rules, your brokerage’s policies, and real-estate advertising regulations — including any required brokerage identification, license numbers, and disclosures, which the Service does not add for you.

9. Infringement claims

If you believe content on or generated through the Service infringes your copyright or other rights, email info@sum28.com with (a) the material and where it appears, (b) your contact information, and (c) a good-faith statement that the use is unauthorized. We will investigate, may remove material, and may suspend or terminate repeat infringers.

10. Disclaimers

The Service is provided “as is.” It includes automated checks that compare output against the inputs you provide and flag language commonly associated with Fair-Housing concerns. These checks are automated assistance only: they are not exhaustive, may miss problems or flag acceptable language, and are not legal or compliance advice. We do not warrant that output is accurate, original, non-infringing, or compliant with the Fair Housing Act, state anti-discrimination laws, MLS rules, or advertising regulations. You must review and approve all output before use, and you remain solely responsible for everything you publish.

11. Limitation of liability

To the maximum extent permitted by law, Sum28 is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the greater of $50 or the amounts you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, willful misconduct, or gross negligence. Some jurisdictions do not allow certain exclusions or limitations; in that case they apply only to the maximum extent permitted.

12. Indemnification

You agree to indemnify Sum28 against third-party claims arising from your inputs, your published content, or your violation of these Terms or applicable law, except to the extent the claim results from our breach of these Terms.

13. Termination

You may delete your account at any time in the iOS app (Account → Delete account) or by emailing info@sum28.com. Deleting your account cancels any active subscription, erases your data as described in our Privacy Policy, and permanently forfeits your remaining credit balance. We may suspend or terminate accounts that materially violate these Terms; in that case unused credits may be forfeited to the extent permitted by law. If we terminate your account for any other reason, or discontinue the Service, we will refund the purchase price of your unused purchased credits or give you reasonable notice to use them.

14. Governing law & disputes

Before filing a claim, you agree to contact us at info@sum28.com describing the dispute and to give us 30 days to try to resolve it informally. These Terms are governed by the laws of the State of California, and disputes will be resolved in the state or federal courts located in California.

15. Changes

We may update these Terms; we’ll post the new effective date and, for material changes, notify you. Continued use means acceptance.
